Abstract

Abstract.

The use of product displays are important in clothing store to create consumer interest, one of them is the Nafara Style fashion store. However, the products that are used as displays are not all directly given to consumers, there are consumers who exchange their products because the displays are not in accordance with what they wants to. The purpose of this study is to find out the theory of Khiyar in Fiqh Muamalah and the concept of Islamic Business Ethics in the provisions of Khiyar, find out the terms of product exchange applied to the Nafara Style Fashion Store, and explain the analysis of Islamic Business Ethics on the application of Khiyar in buying and selling transactions of clothing products at Nafara Style Fashion Store. The research method used is descriptive qualitative method with an empirical legal approach and the type of field research data. Sources of research data obtained from primary data and secondary data, with data collection techniques used are observation, interviews, documentation, and data triangulation (combined). Data analysis techniques by means of data reduction, data presentation, and drawing conclusions. The results of this study indicate that the practice of khiyar at the Nafara Style fashion store applies three types of khiyar, namely khiyar majlis, khiyar requirements and khiyar 'aib. The implementation of the khiyar is in accordance with the legal requirements of the khiyar in Fiqh Muamalah. However, based on the analysis of Islamic Business Ethics on the application of khiyar in the store, it is not appropriate. Because the determination of khiyar is carried out unilaterally by the seller, resulting in losses for the buyer.

Penggunaan display produk menjadi hal penting dalam sebuah toko pakaian untuk menciptakan daya tarik minat konsumen, salah satunya pada toko fashion Nafara Style. Namun produk yang dijadikan display tidak semua langsung diberikan kepada konsumen, sehingga terdapat konsumen yang menukar produknya karena tidak sesuai dengan yang diinginkannya. Tujuan penelitian ini yaitu untuk mengetahui teori Khiyar dalam Fiqh Muamalah dan konsep Etika Bisnis Islam dalam ketentuan Khiyar, mengetahui ketentuan penukaran produk yang diterapkan pada Toko Fashion Nafara Style, dan menjelaskan analisis Etika Bisnis Islam terhadap penerapan Khiyar pada transaksi jual beli produk pakaian di Toko Fashion Nafara Style. Metode penelitian yang digunakan adalah metode kualitatif deskriptif dengan pendekatan hukum empiris dan jenis data penelitian lapangan (field research). Sumber data penelitian diperoleh dari data primer dan data sekunder, dengan teknik pengumpulan data yang digunakan yaitu observasi, wawancara, dokumentasi, dan triangulasi data (gabungan). Teknik analisis data dengan cara reduksi data, penyajian data, dan penarikan kesimpulan. Hasil penelitian ini bahwa praktik khiyar di toko fashion Nafara Style menerapkan tiga jenis khiyar yaitu khiyar majlis, khiyar syarat dan khiyar ‘aib. Pelaksanaan khiyar tersebut telah sesuai berdasarkan syarat sah khiyar dalam Fiqh Muamalah. Namun, berdasarkan analisis Etika Bisnis Islam terhadap penerapan khiyar di toko tersebut tidak sesuai. Karena penentuan khiyar yang dilakukan secara sepihak oleh pihak penjual, sehingga mengakibatkan kerugian bagi pihak pembeli.
