The objectives of his research include analyzing the implementation of the standard operating procedures of the corruption eradication commission in determining suspects in accordance with the criminal procedure law, and knowing the suspects who are declared free based on pretrial decisions are re-established as suspects. The method used is normative legal research that uses secondary legal materials, and uses qualitative normative analysis. In this research, the author analyzes the study of the South Jakarta District Court decision Number 2/PID.PRA/2024/PN JKT SEL. The results of this study are that the KPK as an investigator has committed abuse of power because it has carried out a process that is not in accordance with the provisions of the applicable laws and regulations and in reassigning a suspect by an investigator can be done on the basis of not obtaining sufficient preliminary evidence or finding new evidence, because pretrial is not related to the substance of the case.</p> <p>Abstrak.</p> <div>Praperadilan bertujuan untuk menegakkan hukum dan melindungi hak asasi manusia di tingkat penyidikan, dan praperadilan juga berfungsi sebagai alat pengawasan bagi aparat penegak hukum penegak hukum, dalam hal ini penyidik, karena adanya penyalahgunaan penyalahgunaan wewenang yang diberikan kepadanya. Suatu bukti perbuatan hukum jual beli dapat dibuktikan salah satunya oleh kuitansi. Akan tetapi, kuitansi tidak menguraikan secara rinci suatu perjanjian, maka perlu didukung dengan alat bukti lain yang membuktikan bahwa perjanjian tersebut adalah dasar penerimaan uang yang diuraikan dalam kuitansi. Penyelesaian sengketa tanah dapat diupayakan melalui peranan kantor wilayah Badan Pertanahan Nasional untuk mendapatkan penanganan dan penyelesaian. Adapun alternatif penyelesaian sengketa pertanahan yang dilaksanakan oleh kantor wilayah Badan Pertanahan Nasional dengan cara mediasi sesuai ketentuan Peraturan Menteri Agraria Nomor 21 Tahun 2020. Peran Badan Pertanahan Nasional dalam suatu persengketaan pertanahan adalah sebagai mediator otoritatif yang netral. Akan tetapi, alternatif penyelesaian sengketa melalui upaya mediasi seringkali dinilai tidak efektif dikarenakan sulitnya tercapai kesepakatan perdamaian diantara para pihak yang bersengketa. Maka dari itu penulis tertarik untuk melakukan penelitian deskriptif-analitis dengan metode pedekatan yuridis normatif. Dalam metode pengumpulan data yang digunakan adalah dengan mewawancarai narasumber bersangkutan yang ada kaitannya terhadap penelitian yang diteliti. Penulis juga menggunakan metode penelitian kepustakaan. Data yang dikumpulkan berupa sumber-sumber hukum yang terdiri dari sumber hukum primer yang berdasarkan Undang-Undang Dasar 1945, Undang-Undang Pokok Agraria, KUHPerdata, Peraturan Pemerintah Nomor 24 Tahun 1997. Proses mediasi baru dapat dilakukan apabila para pihak yang terlibat sengketa sudah saling sepakat untuk menyelesaikan sengketa secara mediasi. Kemudian dalam sistem hukum Lawrence Friedman menunjukkan terdapat persoalan dalam aspek budaya hukum</p> <p><em><strong>ABSTRACT-</strong> In land disputes, a land ownership can be proven, one of which is based on a legal act of buying and selling land. However, a receipt does not detail a contract in full, so it needs to be supported by other evidence that proves that the contract is the basis for the acceptance of the money detailed in the receipt. The settlement of land disputes can be attempted through the role of the regional office of the National Land Agency to obtain handling and settlement. The alternative land dispute settlement carried out by the regional office of the National Land Agency through mediation in accordance with the provisions of the Minister of Agrarian Affairs Regulation Number 21 of 2020. The role of the National Land Agency in a land dispute is as an authoritative and neutral mediator. However, the alternative settlement through mediation efforts is often considered ineffective due to the difficulty of reaching a peace agreement among the disputing parties. Therefore, the writer is interested in conducting a descriptive-analytic research with a normative legal approach method. In the data collection method used, the writer interviewed </em><em>relevant sources related to the research being studied. The writer also used a library research method. The collected data consisted of legal sources, including primary legal sources based on the 1945 Constitution, the Basic Agrarian Law, the Civil Code, and Government Regulation Number 24 of 1997. Then, secondary legal sources based on books, journals, articles, and opinions of legal experts... Based on this research, it was found that the National Land Agency (BPN) has a role as a mediator that helps disputing parties understand each other's perspectives and find what is important to them. The mediation process can only be carried out if the parties involved in the dispute agree to settle the dispute through mediation. The problems in this study are (1) whether the implementation of child witness protection in Indonesia and Germany is in accordance with the laws in each country, and (2) whether the handling by the institution has provided a sense of security for child witnesses of sexual crimes. By using comparative juridical, the results of this research are: that the implementation of regulations on the protection of child victims of sexual crimes in both countries is in accordance with the regulations on the protection of witnesses and victims. Apart from that, regulations regarding the importance of fulfilling the rights of children at school age are regulated in Law number 35 of 2014 concerning Child Protection (Child Protection Law), which states that every child has the right to receive education and teaching in the context of their personal development and level of intelligence in accordance with interest and talent. The majority of the population in Indonesia is from a Muslim background, whose teachings place great importance on fulfilling children's rights, apparently this is not a guarantee as a solution to the success of the country's goals in Indonesia. </em><em> In connection with this, the author is very interested in researching it with the thesis research title "Fulfillment of Children's Educational Rights from Victims of Parental Exploitation in View of Child Protection Laws and Islamic Law". The problem formulation of this research includes: (1) How are the educational rights of children victims of parental exploitation fulfilled based on the Child Protection Law and Islamic Law? (2) What is the solution to the educational rights of children who are victims of parental exploitation based on the Child Protection Law and Islamic Law? </em><em>The author conducted research using normative juridical methods, namely qualitatively collecting research material obtained through literature study. Thus, the data collected is analyzed against statutory regulations and other legal sources such as Islamic law, as well as other data that supports the answer to the problem being researched so that it is close to accuracy.</em>The results of this research include: (1) Fulfillment of the educational rights of children who are victims of parental exploitation, both based on the Child Protection Law and Islamic Law, has not been optimally implemented in Indonesia. This can be seen from the data produced in the author's research, that there is still quite a large amount of exploitation of children at school age, reaching 3.3 million children out of school in several big cities in Indonesia, even though Islamic law is supposed to be a guide to life for Muslims as residents. The largest in Indonesia, in its teachings, it is mandatory for every parent to prepare a strong generation in the future. (2) The solutions that the author tries to recommend based on the research that has been carried out are: (1) Law enforcement as regulated in the Child Protection Law with legal certainty by the government in order to realize the national goal, namely to make the nation's life intelligent with full responsibility; (2) Maximizing the role of religious institutions and community figures so that the fulfillment of the educational rights of children who are victims of child exploitation can be minimized, as well as providing outreach on the importance of children's education both according to positive Indonesian law and Islamic law</p> <p><strong>Abstrak</strong></p> <p class="07StyleBodyAbstrak" style="line-height: normal;"><span lang="SV" style="letter-spacing: 0pt;">Eksploitasi anak usia sekolah bertentangan dengan tujuan konstitusional Indonesia, sebagaimana tercantum dalam Pembukaan UUD 1945, yaitu mencerdaskan kehidupan bangsa. UU No. 35 Tahun 2014 tentang Perlindungan Anak menegaskan hak anak atas pendidikan untuk pengembangan pribadi dan intelektual. Meski ajaran Islam, yang dianut mayoritas penduduk Indonesia, juga menekankan pentingnya hak anak, eksploitasi anak tetap menjadi masalah. Penelitian ini, berjudul “Pemenuhan Hak Pendidikan Anak Korban Eksploitasi Orang Tua Ditinjau dari Undang-Undang Perlindungan Anak dan Hukum Islam,” membahas dua pertanyaan utama: (1) Bagaimana pemenuhan hak pendidikan anak korban eksploitasi menurut UU Perlindungan Anak dan Hukum Islam? (2) Apa solusi efektif untuk memenuhi hak tersebut? Melalui pendekatan yuridis normatif, penelitian ini menemukan bahwa pemenuhan hak pendidikan anak korban eksploitasi belum optimal. Data menunjukkan 3,3 juta anak tidak bersekolah, mencerminkan eksploitasi yang terus berlangsung. Layanan perbankan saat ini berkembang cepat dengan adanya teknologi yang bertujuan untuk memudahkan akses layanan terhadap nasabah. Bank berkewajiban untuk merahasiakan data nasabahnya dengan prinsip kerahasiaan (<em>confidential principle</em>). Sebagaimana diatur dalam Pasal 40 Undang-Undang No. 10 Tahun 1998 tentang Perbankan yang menegaskan bahwa kerahasiaan ini diperlukan untuk mendapatkan kepercayaan masyarakat demi kepentingan bank itu sendiri. Tentang rahasia data nasabah, didukung pula oleh Pasal 36 Undang-Undang No. 27 Tahun 2022 tentang Perlindungan Data Pribadi yang menegaskan tentang pengendali data pribadi wajib melakukan pemrosesan data pribadi. Namun demikian, dalam paraktiknya rahasia data nasabah terdapat kebocoran karena adanya peretasan oleh hecker sebagaimana terjadi di Bank Syariah Indonesia (BSI) tahun 2023. Terkait hal tersebut permasalahan yang akan dibahas adalah tentang implementasi perlindungan data nasabah di&nbsp;&nbsp; Bank BSI dan perlindungan hukum nasabah&nbsp;&nbsp; Bank BSI yang data pribadinya diretas. Metode pendekatan yang digunakan adalah yuridis normatif yaitu pendekatan yang dilakukan dengan cara meneliti bahan kepustakaan atau data sekunder. Penelitian ini menggunakan bahan Pustaka atau data sekunder. Hasil penelitian yaitu implementasi perlindungan rahasia data nasabah&nbsp;&nbsp; Bank BSI yaitu dengan menerapkan teknologi yang aman, tingkat transparansi yang tinggi dalam penanganan pelanggaran, serta melindungi privasi dan keamanan data pribadi nasabah agar tidak terjadi kebocoran data pribadi. Perlindungan Hukum terhadap nasabah yang data pribadinya diretas dilakukan dengan dua cara, yaitu perlindungan secara internal dan perlindungan secara eksternal. Saran untuk mengatasi permasalahan tersebut, perlu adanya intervensi Otoritas Jasa Keuangan (OJK) di bidang perlindungan konsumen sektor jasa keuangan.&nbsp;</p> <p><strong>ABSTRACT</strong><strong>: </strong>Banking, as an essential sector in social life, has the authority to exchange money and financial transactions. Banking services are currently developing rapidly with technology which aims to facilitate service access for customers. Banks are obliged to keep their customers' data confidential according to the confidential principle. As regulated in Article 40 of Law no. 10 of 1998 concerning Banking which emphasizes that this confidentiality is necessary to gain public trust for the sake of the bank itself. Regarding the confidentiality of customer data, it is also supported by Article 36 of Law no. 27 of 2022 concerning Personal Data Protection which confirms that personal data controllers are obliged to process personal data. However, in practice, confidential customer data can be leaked due to hacking by hackers, as happened at Bank Syariah Indonesia (BSI) in 2023. Related to this, the problem that will be discussed is the implementation of customer data protection at Bank BSI and legal protection for BSI Bank customers. his personal data was hacked. The approach method used is normative juridical, namely an approach carried out by researching library materials or secondary data. This research uses library materials or secondary data. The results of the research are the implementation of confidential protection of BSI Bank customer data, namely by implementing safe technology, a high level of transparency in handling violations, as well as protecting the privacy and security of customers' personal data to prevent personal data leaks. Legal protection for customers whose personal data is hacked is carried out in two ways, namely internal protection and external protection. However, in this day and age of globalization which requires the improvement of a country's economy, the regulation has not been optimally implemented by customary stakeholders and local governments due to misunderstandings of the hierarchy of laws and regulations.</span> <span style="font-weight: 400;">Until now, the Nagari Kapa indigenous people have not been determined by the local government, so that this is a gap in disputes over control of a right, especially customary rights that should be given to indigenous peoples, but customary rights are rights for people who have been designated as indigenous peoples. The data collection technique in this study uses secondary data obtained from literature studies, laws, expert opinions and interviews.</span> <span style="font-weight: 400;">and explain between legal arrangements and their implementation practices in the protection of customary rights. The purpose of this study is to find out the obstacles and implementation of the research, so that it gives rise to legal norms. And the findings of this study show that the Nagari kapa indigenous people still exist and exist, as can be seen from the findings carried out by the researcher, such as customary history, customary territories, customary assets, and customary institutions but have not been designated as indigenous peoples, so that there are weaknesses in protecting the rights of indigenous peoples.</span></strong></p> <p><strong>Abstrak</strong></p> <p><span style="font-weight: 400;">Hak Negara menguasai tanah merupakan hak yang mngeartikan Negara menguasai dalam bentuk pengelolaan hak atas tanah,&nbsp;oleh karena itu diaturlah peraturan Peraturan Pemerintah Dalam Negri No 52 Tahun 2014 Tentang Pedoman Pengakuan dan Perlindungan Masyarakat Hukum Adat yang berfungsi sebagai pedoman pengakuan masyarakat adat sehingga diakui pula hak-hak tradisionalnya oleh Negara.&nbsp;Namun pada masa dewasa ini dan pengaruh era globalisasi yangmng mengharuskan peningkatan ekonomi sebuah negara&nbsp; implementasinya,&nbsp;peraturan tersebut belum secara optimal dilakukan oleh pemangku adat maupun pemerintah daerah setempat yang disebabkan kesalah pahaman terhadap hierarki peraturan perundang-undangan. Sampai saat ini Masyarakat adat Nagari Kapa masih belum ditetapkan oleh pemerintah daerah setempat, sehingga hal tersebut menjadi celah perselisihan penguasaan atas suatu hak, terutaama hak ulayat yang seharusnya diberikan kepada masyarakat adat, namun hak ulayat merupakan hak bagi masyarakat yang sudah ditetapkan sebagai masyarakat adat. Narcotics use nowadays has been frequently abused by street children. According to data from the National Narcotics Agency (BNN), the prevalence of drug abuse has increased from 1.80% to 1.95%. This research uses a method of normative jurisprudence with research specifications using descriptive analysis. Data is collected by library/literature study using secondary data and data analysis used namely qualitative data analysis. The result of this study is that the state police of the Republic of Indonesia under the law No. 2 of 2002 on the police which explains that the police agency has the right to enforce the law and protect the public by carrying out two types of preventive or repressive efforts. The protection that protects street children has not yet been enacted specifically for street children, but is still considered like any other child. The role of the police in the fight against drug crimes perpetrated by street children is crucial, because its primary task is to create national stability, namely as a guide, mentor and service to the community of child protection, which is all activities to guarantee and protect the child and his right to live, grow, develop and participate in an optimal manner in accordance with the dignity and dignity of humanity. Preventing and combating drug abuse amongst street children requires more massive efforts from various parties such as the police, the National Narcotics Agency, the public to provide child protection and suppress drug trafficking and use in Indonesia.</span></p> <p class="07StyleBodyAbstrak" style="line-height: normal;"><span lang="SV" style="letter-spacing: 0pt;">Abstrak</span></p> <p class="07StyleBodyAbstrak" style="line-height: normal;"><span lang="SV" style="letter-spacing: 0pt;">Obat-obatan narkotika menimbulkan risiko kecanduan yang signifikan, terutama di kalangan anak jalanan, yang penyalahgunaannya terus meningkat. Badan Narkotika Nasional (BNN) melaporkan peningkatan prevalensi penyalahgunaan narkotika dari 1,80% menjadi 1,95%. Penelitian ini menggunakan yurisprudensi normatif dan analisis deskriptif, dengan menggunakan data sekunder yang dikumpulkan melalui tinjauan literatur. Temuan penelitian menunjukkan bahwa Kepolisian Republik Indonesia, di bawah UU No. 2 Tahun 2002, berwenang untuk menegakkan hukum dan memastikan keamanan publik melalui tindakan preventif dan represif. Namun, perlindungan khusus untuk anak jalanan masih belum memadai, karena mereka diperlakukan sama dengan anak di bawah umur lainnya. Polisi memainkan peran penting dalam memerangi kejahatan narkoba yang melibatkan anak jalanan, karena tanggung jawab utama mereka adalah menjaga stabilitas nasional dan memberikan dukungan masyarakat. As a health service facility, of course hospitals must provide health supplies. One form of this is infusion supplies, and their services must ensure patient safety. However, during its implementation, it was found that cases of harm suffered by patients ranged from diarrhea to suspected tissue death in their veins due to the infusion. This research aims to determine the action of installing an IV that results in harm to the patient in relation to health efforts according to Law Number 17 of 2023 concerning health and to find out about legal protection for victims who experience losses due to the installation of an IV by Hospital X according to Law Number 17 of 2023 concerning health. The method used is normative legal. The research specifications in this study are descriptive analyses. The data collection technique is library study, and the analysis method in this research uses qualitative analysis methods. The results of this study explain that if the infusion action causes harm, then the hospital must be responsible for the loss. In line with Article 193 of Law Number 17 of 2023 concerning health, judging from the pattern of the legal relationship between the patient and the hospital, it is an agreement in the form of a contract.</p> <p><strong>ABSTRAK </strong></p> <p>Jaminan Kesehatan bagi masyarakat merupakan upaya yang sangat sentral sebab merupakan sebuah upaya guna menunjang Hak Asasi Manusia. Environmental management includes planning, utilization, control, maintenance, supervision and law enforcement. The main priority of this management is to prevent pollution and damage caused by human activities that exceed environmental standards, such as air, air and soil pollution, as well as damage to habitats and ecosystems. Environmental damage caused by human activities that exceed the carrying capacity of the environment can result in economic and social losses for society. Like nickel mining by PT. Various mines in the Mandiodo Block, North Konawe Regency, Southeast Sulawesi, have caused environmental pollution. The Ministry of Environment and Forestry (KLHK) discovered air and land pollution in the area in 2022 due to nickel mining activities that did not comply with environmental standards. This mining activity has caused the loss of people's livelihoods, the conversion of agricultural land to mining land, and pollution of sea waters. This research aims to determine civil law enforcement regarding environmental pollution due to mining waste which pollutes the air and land by PT Aneka Tambang in the Mandiodo Block and civil law enforcement regarding environmental pollution due to mining activities based on the Environmental Protection and Management Law (UUPLH) and Mineral and Coal Law (UU MINERBA) by PT Aneka Tambang in the Madiodo Block, North Konawe, Southeast Sulawesi. This research uses normative juridical legal research with qualitative analysis methods which are described descriptively using secondary data obtained from library study data collection methods in the form of primary legal materials, secondary legal materials and tertiary legal materials. Based on the research results, it is known that environmental law enforcement due to mining waste polluting the air and land by PT Aneka Tambang in the Mandiodo Block is by providing administrative sanctions against perpetrators of pollution and the victims have the right to compensation both material and non-material. In relation to civil law enforcement against environmental pollution in the practical settings in the Mandiodo Block, it is known that it has not been effective and that many environments are still polluted due to mining activities, causing local communities to lose their livelihoods. Law enforcement should aim to realize the wishes of the law, but in this case the community has not received justice because there is no support from any component of legal force. The existence of absolute responsibility towards UUPLH is expected to ensure that pollution victims receive compensation without requiring proof of fault and encourage violators to apply the precautionary principle in accordance with Article 88 of UUPLH.</p> <p><strong>ABSTRAK</strong></p> <p class="07StyleBodyAbstrak" style="line-height: normal;"><span lang="SV" style="letter-spacing: 0pt;">Undang-Undang Perlindungan dan Pengelolaan Lingkungan Hidup (UUPLH) mengatur pengelolaan lingkungan melalui perencanaan, pemanfaatan, pengendalian, pemeliharaan, pengawasan, dan penegakan hukum untuk mencegah pencemaran dan kerusakan ekologis. Kasus pencemaran akibat penambangan nikel oleh PT Aneka Tambang di Blok Mandiodo, Konawe Utara, menimbulkan dampak serius seperti pencemaran udara, tanah, dan air, serta hilangnya mata pencaharian dan konversi lahan pertanian. Penelitian ini bertujuan mengkaji penegakan hukum perdata terkait pencemaran lingkungan dari limbah tambang menggunakan pendekatan yuridis normatif dengan metode kualitatif. Hasil penelitian menunjukkan penegakan hukum belum efektif. Banyak wilayah tetap tercemar, memengaruhi mata pencaharian masyarakat. Korban pencemaran berhak atas kompensasi tanpa pembuktian kesalahan, sebagaimana diatur dalam UUPLH. Namun, lemahnya dukungan otoritas hukum menghambat keadilan bagi masyarakat terdampak. Memperkuat penegakan hukum menjadi hal krusial untuk memastikan kepatuhan dan perlindungan lingkungan secara efektif.
