Abstract

Abstract. In the practice of buying and selling houses with a wholesale system that occurred in Cihanjuang Village, Parongpong District, some consumers experienced losses because the contractor did not carry out his obligations as agreed at the beginning of the agreement, the contractor was negligent and broke his promise to the consumer. Based on this phenomenon, the problems in this research are formulated as follows: 1). How is the practice of buying and selling houses with a wholesale system? 2). What is the review of muamalah fiqh on buying and selling houses with a wholesale system? 3). What are the factors in consumer behavior towards buying and selling houses with a wholesale system? The research method used is qualitative method or field method. The data collection technique used is interviews, as well as documentation, internet, books, and articles and then collected for analysis using qualitative descriptive methods. The results of this study indicate that the buying and selling of houses with a wholesale system that occurs in Cihanjuang Village is not in accordance with the legal requirements of the istishna sale and purchase in terms of the object, the goods that have been ordered are not according to the agreement at the beginning, and the processing time exceeds the predetermined time limit, and the absence of khiyar rights given by the contractor to consumers, in terms of the factors that cause consumers to choose buying and selling with the wholesale system, which is caused by cultural, social, personal, and psychological factors.

Abstrak. Dalam praktek Jual beli rumah dengan sistem borongan yang terjadi di Desa Cihanjuang Kecamatan Parongpong beberapa konsumen mengalami kerugian karena pemborong tidak melaksanakan kewajibannya sebagaimana yang telah di sepakati di awal perjanjian, pemborong telah lalai dan ingkar janji terhap konsumen. Berdasarkan Fenomena tersebut maka permasalahan dalam penelitian ini dirumuskan sebagai berikut : 1). Bagaimana peraktek jual beli rumah dengan sistem borongan ? 2). Bagaimana Tinjauan fiqih muamalah terhadap jual beli rumah dengan sistem borongan ? 3). Apa faktor perilakau konsumen terhadap jual belirumah dengan sistem borongan?  Metode penelitian yang digunakan yaitu metode kualitatif atau metode lapangan tekhnik pengumpulan data yang digunakan yaitu wawancara, serta dokumentasi, internet,buku, dan artikel kemudian dikumpulkan untuk dianalisis menggunakan metode deskripstif kualitatif. Hasil dari penelitian ini menunjukan bahwa jual beli rumah dengan sistem borongan yang terjadi di Desa Cihanjuang tidak sesuai dengan syarat sahnya jual beli istishna dari segi objeknya, barang yang telah di pesan tidak sesuai kesepakatan di awal, serta waktu pengerjaan melampaui batas waktu yang telah ditentukan, dan tidak adanya hak khiyar yang diberikan pemborong kepada konsumen,  dari segi faktor-faktor yang mengakibatkan konsumen memilih jualbeli dengan sistem borongan yaitu disebabkan oleh faktor budaya, social, pribadi, dan psikologis.
