Abstract

Abstract. This study aims to determine the practice of endorsement services on the Instagram account @naryarahma, to analyze the DSN-MUI Fatwa No. 112/DSN-MUI/IX/2017 concerning the Ijârah Agreement for the practice of endorsement services on the Instagram account @naryarahma. This research method uses a qualitative case study approach. The data sources used are primary data in the form of interviews, observations, and documentation related to endorsement practices and secondary data in the form of articles, journals, theses, books, websites related to research. The data analysis method used is empirical juridical. The results of this study are the analysis of the DSN-MUI Fatwa No. 112/DSN-MUI/IX/2017 concerning Ijârah Contracts for the practice of endorsement services on the @naryarahma Instagram account, there are discrepancies with the fourth, seventh and eighth provisions in the fatwa, because the product to be promoted and the term of work are not clearly and specifically known at the time of the agreement. In addition, there are online shops that have passed the payment due date and have not paid ujrah. This discrepancy involves an element of jahalah (ignorance). Based on fiqh, this has implications for the cancellation of the contract because it does not fulfill the pillars and conditions of the ijârah contract.

Abstrak. Penelitian ini bertujuan untuk mengetahui praktik jasa endorsement pada akun Instagram @naryarahma, menganalisis Fatwa DSN-MUI No. 112/DSN-MUI/IX/2017 tentang Akad Ijârah terhadap Praktik jasa endorsement pada akun Instagram @naryarahma. Metode penelitian ini menggunakan kualitatif dengan pendekatan studi kasus. Sumber data yang digunakan adalah data primer berupa hasil wawancara, observasi, serta dokumentasi terkait praktik endorsement dan data sekunder berupa artikel, jurnal, skripsi, buku, website yang berkaitan dengan penelitian. Metode analisis data yang digunakan yaitu yuridis empiris. Hasil penelitian ini yaitu analisis Fatwa DSN-MUI No. 112/DSN-MUI/IX/2017 tentang Akad Ijârah terhadap praktik jasa endorsement pada akun Instagram @naryarahma terdapat ketidaksesuaian dengan ketentuan keempat, ketujuh dan kedelapan dalam fatwa, karena produk yang akan dipromosikan serta jangka waktu kerjanya tidak diketahui secara jelas dan spesifik pada saat kesepakatan selain itu terdapat pihak online shop yang melewati jatuh tempo pembayaran dan tidak membayarkan ujrah. Ketidaksesuaian ini melibatkan adanya unsur jahalah (ketidaktahuan). Berdasarkan fikih hal ini berimplikasi pada batalnya akad karena tidak memenuhi rukun dan syarat akad ijârah.
